This world has around 195 countries and each one has its own policies while drafting the country laws which are always drafted in a way to harmonize the nationals of the country as India under Trade Marks System recognizes prior rights superior to statutory rights obtained subsequently in cases of conflicting marks where dishonesty while adoption seems apparent.
But not all the countries of this world follows this system of ascertaining and recognizing
Prior rights while protecting trademarks and gives weight-age to First – to – File Principle wherein an applicant who has filed the application for registration for the mark may be identically to the earlier existed mark in other foreign country will be deemed as the exclusive owner of the mark.
China, Taiwan, Canada, Brasil, Hong Kong, Macau, Indonesia, Japan, Nepal, Continental European Countries, Some South American And Many African Countries and many other countries.
